The purpose of this rule filing is to assist in the implementation of Chapter 72, Laws of 2007 (ESSB 5920). This proposed rulemaking will include new rules to clarify the process and factors L&I will consider for approving or denying nonaccredited or unlicensed training programs for injured workers. A public hearing has been scheduled for October 6, 2009 at 10:00 am at the L&I Tukwila Service Location

The proposed rules will assist in the implementation of Chapter 72, Laws of 2007 (ESSB 5920). This proposed rulemaking will include new rules to clarify the process and requirements for making application for option 2 vocational costs, and define which vocational costs require department or self-insurer oversight and the vocational costs that can be paid. A public hearing will be held on October 6, 2009 at 10:00 am at the L&I Tukwila Service Location.

The pupose of this rulemaking is to mplement Chapter 72, Laws of 2007 (ESSB 5920) which increases benefits for eligible workers, provides an alternative to vocational services that a worker may accept, and includes accountability to reduce delays and improve vocational service outcomes. The changes were adopted 2/29/2008 and became effective on 4/1/2008.

In response to a petition for rule making received on March 1, 2007, the department will develop a new rule or amend WAC 296-19A-310. The proposed rule making will clarify how the department will purchase services from individual vocational providers in contiguous service locations. Hearings to held in Everett, Tukwila, Tumwater, Vancouver, Yakima and Spokane in October 2007.

The rule-making will repeal rules (WAC 296-19A-280, 296-19A-290 and 296-19A-300) that are no longer used by the department.

The purpose of this rule making is to consider amending WAC 296-19A-125, WAC 296-19A-130 and WAC 296-19A-210(3), which relate to qualification requirements for vocational providers delivering forensic services.
