Seattle-area asbestos contractor cited and fined $80,000 by Labor & Industries

A Seattle contractor has been cited and fined more than $80,000 by the state Department of Labor & Industries for asbestos-removal activities at three North Seattle residences in recent months.

L&I cited Robbie C. Grant - doing business as Cossie Construction, 7918 S. Wolcott St., Seattle - on March 19 for 10 willful violations of state regulations governing the handling and removal of asbestos. The company has 15 working days from the time the citations are received to appeal the violations and penalties.

L&I cites willful violations when an employer either knowingly or intentionally violated safety and health regulations, or was aware that a hazardous condition existed and made no reasonable effort to eliminate the condition.

After issuing the citations, L&I inspectors also obtained a King County Superior Court temporary restraining order against the company. The court ordered Grant to stop contracting to do asbestos removal until it becomes certified by L&I and complies with laws relating to asbestos removal.

In addition, the company has outstanding willful citations with more than $26,000 in penalties, interest and fees stemming from four citations issued by L&I last May. Those citations were not appealed by the company and they will continue to incur interest, surcharges and other fees until paid.

L&I cited the company variously for violating asbestos-related regulations by failing to:

  • Obtain asbestos contractor certification.

  • File proper notification of asbestos removal projects.

  • Ensure all asbestos debris was removed.

  • Conduct air clearance monitoring as required.

The complaints against the company were lodged by residents who had contracted for his services and the Puget Sound Air Pollution Control Agency. The company also has contracted asbestos-removal services in the greater Portland area.

L&I safety and health inspectors remind residents that asbestos removal contractors must be certified by the department.
