The Department of Labor & Industries’ (L&I) Division of Occupational Safety & Health (DOSH) is updating the requirements in chapter 296-56 WAC, Safety standards - Longshore, stevedore and waterfront related operations. To initiate the rulemaking process, a Preproposal Statement of Inquiry (WSR 22-18-081) was filed on September 6, 2022.

L&I is updating the standard to align with the following:
• Substitute House Bill (SHB) 1706 (RCW 70.54.480), passed by the legislature in 2022, regarding drayage truck operators access to restrooms when operating in or on a port or rail yard property. New requirements include access to restrooms and dedicated space for lactation. L&I and the Washington State Department of Health have jurisdiction to enforce the requirements set forth in SHB 1706.
• Federal Occupational Safety and Health Administration’s (OSHA) requirements for marine terminals found in 29 CFR 1917.

Additionally, this rulemaking will incorporate housekeeping and formatting changes.

DOSH shared draft language with interested parties in the longshore, stevedore and waterfront related operations industries during earlier stakeholder meetings in 2022-2024. Thank you to all who attended and provided input. During the upcoming meeting, DOSH staff will share an updated draft with stakeholders.

L&I invites parties interested in longshore, stevedore and waterfront related operations to attend this virtual stakeholder meeting. During the meeting, L&I will provide an overview of the rulemaking and share the updated draft language, followed by an open forum for questions and comments. L&I welcomes and encourages stakeholder participation and feedback.
