Purpose

The purpose of this rulemaking is to update Chapter 296-128 WAC to clarify and enforce new requirements pertaining to sick leave. Engrossed Substitute Senate Bill 5111 (ESSB 5111), from the 2023 legislative session, amended RCW 49.46.210 and 49.46.180 to require payment for accrued and unused sick leave for certain construction workers following separation. Additional updates address existing statutory requirements in RCW 49.46.180, as well as cleanup the paid sick leave rule.
