Status 

L&I filed the DOSH Permanent Rulemaking Order (CR-103P) and the FPLS Permanent Rulemaking Order (CR-103P) on May 31, 2024. The rule becomes effective July 1, 2024.

Overview

L&I responded to Second Substitute House Bill (2SHB) 1762 (2023), establishing requirements for warehouse distribution centers. 

2SHB 1762/chapter 49.84 RCW authorizes L&I to enforce the new requirements with certain violations enforced under the Washington Industrial Safety and Health Act.

The adopted rules, effective July 1, 2024:

  • Provide definitions for clarity;
  • Reiterate quota time period and reasonable travel time requirements from 2SHB 1762;
  • Clarify a method for measuring employer size to help accurately determine whether an employer is covered by the rules;
  • Clarify violations of WISHA related to quotas;
  • Provide a table of examples of activities and how a violation of chapter 49.84 RCW could contribute to a violation of the safety standards;
  • Clarify employer recordkeeping requirements;
  • Clarify enforcement procedures;
  • Clarify employee protection from adverse action for failure to meet a quota; and
  • Clarify retaliation protections and enforcement.
