Severe Violator Enforcement Program (SVEP)

The Severe Violator Enforcement Program identifies employers who have demonstrated indifference to L&I safety & health requirements by knowingly and repeatedly ignoring these responsibilities, and/or by failing to correct hazards identified in an L&I compliance inspection.

Employers in this program are subject to increased:

• mandatory follow-up inspections
• awareness and scrutiny from L&I compliance
• corporate-wide agreements where appropriate
• enhanced settlement agreements, and
• court enforcement.

How is an employer removed from the list?

An employer may be removed from the SVEP after three years from the date of the qualifying inspection’s final order. Employers must have:

• Received at least one follow-up inspection.
• Abated all SVEP-related hazards affirmed as violations.
• Paid all final penalties.
• Abided by and completed all settlement provisions, and
• Must not have received any additional serious citations related to the qualifying hazards identified in the SVEP inspection, at any of that employer’s establishments.

If the employer fails to comply with any of the above, the SVEP designation will remain for an additional three years, and the employer will be reevaluated using the same criteria.

Severe Violator Enforcement Program (SVEP) list

This list is shared with OSHA and other state plans. Employers identified to be on the Washington State SVEP list, may be inspected in other states. This is to determine if similar hazards exist in other facilities owned by that employer across the nation. This list does not include public entities such as government agencies, police, and fire departments (submit a Public Records request to get the full list). All inspections in this list are a final order. This means that the inspection Citation & Notice was not appealed, or that any appeal has been resolved.
